Midweek Breakaway Competition terms and conditions

RULES AND TERMS OF [INSERT NAME OF] COMPETITION

These rules apply to the Midweek Breakaway competition (the “competition”)
The competition is being conducted and run solely by Twisters Pub, with registration number: 2014/228682/07
Please contact us on 071 609 5050 (weekdays during office hours 08h00 – 17h00) if you do not understand any part of these rules or if you have any questions about the rules of the the competition.
By entering the competition, you confirm that you have read and agree to be legally bound to these rules.

1. IMPORTANT NOTICE

These terms and rules contain certain provisions which appear in similar text to this clause and which:
1.1 may limit the risk or liability of Twisters Pub; and
1.2 may create risk or liability for yourself and/or your company/employer; and
1.3 may compel you and/or your company/employer to indemnify Twisters Pub or a third party; and
1.4 may serve as an acknowledgement, by you and/or your company/employer, of a fact.

2. DURATION

2.1 The competition starts at 09h00 on the 1st day of November 2016 and shall cease at 23h59 on the 30th day of November 2016. This above-mentioned time period is the conclusive “competition period”.
2.2 Twisters Pub reserves the right to extend the duration of the competition, subject to the provisions of these terms and rules.

3. QUALIFICATIONS TO ENTRY

3.1 All persons, including South African Citizens and Foreign Nationals may enter the competition.
3.2 Participants must be at least 18 years old.
3.3 The following persons may not take part in this competition;
3.3.1 Twisters Pub’s director(s), member(s), partner(s), employee(s), agencies(s), or consultant(s) relating to this competition.
3.3.2 Any supplier of goods and services in connection with this competition.
3.3.3 The spouse, life partner, siblings, children, or parents of any of the persons named above.
3.3.4 Juristic Persons

in the event that the above-mentioned persons do enter and win, the prize will be forfeited (given up) and a new draw will be conducted.

4. HOW TO ENTER

4.1 Participants must order, and pay for a meal from the official Twisters Pub’s menu.
4.2 The Participant shall, subsequent to paying for their meal and receiving a receipt slip, write out their name and surname as well as their cellular phone number on the back of their receipt and place the receipt into the designated box located in Pub.
4.3 The completed receipt slip shall constitute the entry into the competition and acknowledgement, and acceptance of these rules.
4.4 The receipt and the phone number therein shall constitute prima facie proof of the participant having personally ordered, and paid for a meal in terms of rule 4.1 above.
4.5 All Participants are entitled to enter more than once.

5. PRIZES

5.1 The prize shall be a Holiday to any destination in South Africa to the value of R2000.00 (two thousand rand).
5.2 The holiday is redeemable from the 1st day of January 2017, until and including the 28th day of February 2017.
5.3 Please note that this holiday is limited to a “work week” holiday. The word “work week” shall possess its ordinary, dictionary meaning for the purposes of these rules.
5.4 The prize is restricted to the accommodation. The participants hereby acknowledge that all other incidental costs pertaining to the “holiday” are not included in this prize.
5.5 The Prize is non-transferable and may not be redeemed for its cash value.


6. METHOD OF SELECTING THE WINNING PARTICIPANT AND NOTIFICATION

6.1 An authorised member of Twisters Pub shall conduct a lucky draw and a total of 10 (ten) receipt slips shall be drawn from the designated box.
6.2 Take note that the phrase “lucky draw” shall be defined as a draw whereby an authorised person shall pick, at random, by chance a receipt slip from the designated box.
6.3 These 10 (ten) receipt slips shall contain the name and surname as well as the cellular phone number of the participating members (hereinafter referred to as the finalists).
6.4 The finalists will be notified by way of SMS (Short Message Service) in the month of December 2016 and will be required to attend the live drawing of the ultimate winner.
6.5 There shall be only 1 (one) ultimate winner. Who shall be selected from these finalists.
6.6 The winner shall be selected by way of another lucky draw which shall be conducted at Twisters Pub on the 30th of December 2016.
6.7 The ultimate winner must be present at Twisters Pub on 30 December 2016 in order to win the prize.
6.8 Failure to be present shall result in an immediate disqualification from the following lucky draw.
6.9 The Prize is non-transferable and may not be redeemed for its cash value.
6.10 If the ultimate winner is for any reason unable to collect/redeem the prize due to unavailability or any other reason whatsoever, the prize shall be forfeited unconditionally.
6.11 In the event that an event as described in 6.10 above shall occur there shall be no redraw.
6.12 The draw shall be conducted under the supervision of an independent attorney.


7. GROUNDS FOR DISQUALIFICATION

7.1 Participations that do any of the following or attempt to do any of the following, whether alone or through anyone else will immediately be disqualified from winning a prize:
7.1.1 Manipulating the outcome of the draw ,or the entering of the competition;
7.1.2 Bribing officials/members/persons conducting the draw or other related persons, in order to try to gain an unfair advantage;
7.1.3 gaining an unfair advantage in an unethical, deceitful or wrongful manner

8. GENERAL

8.1 Twisters Pub has the right to end this competition at any time. If this happens Twisters will publish a notice on Facebook and you agree to waive (give up) any rights that you may have about this competition and acknowledge that you will have no rights against Twisters Pub.
8.2 Twisters Pub reserves the right to change these rules. These changes will likewise be communicated to the participants/potential participants by way of a Facebook post and shall be accessible on the Facebook page.
8.3 For convenience only, the date on which these rules were last amended is shown above. It is your responsibility to check the Facebook page for amendments to these rules.
8.4 If any term, condition, provision or performance, or any part of a term, condition, provision or performance of this Agreement is determined to be invalid, illegal, unlawful or unenforceable to any extent, that term, condition, provision or performance or the relevant part thereof shall be severed from the remaining terms, conditions, provisions and performance of this Agreement, or amended to make it valid, legal, lawful and enforceable, in such a manner as to leave the amended Agreement substantially the same in essence, and this Agreement so amended shall remain in force and effect.
8.5 Wherever time has been referred to in these rules, it refers GMT +2
8.6 These rules and the competition are governed by the law of the Republic of South Africa.
8.7 An independent attorney/auditor will oversee the prize allocation process in order to ensure the fairness thereof.
